Terms and Conditions of Quotation, Installation and Warranty

These Terms and Conditions apply to quotations, estimates, work orders, invoices, installations, fabrication, supplied products and services provided by All Terrain Action. Acceptance of a quotation, payment of a deposit, approval of a work order, or authorisation for work to commence constitutes acceptance of these Terms and Conditions.

The All Terrain Promise

By accepting this quotation, you acknowledge and agree to The All Terrain Promise, including our commitment to quality workmanship, customer satisfaction, warranty support, and the Terms and Conditions available in full below.

The All Terrain Promise means that if we recommend, supply or install a solution, we stand behind our workmanship, support you after installation, and will work with you to rectify issues where something has not been completed correctly or does not meet the agreed scope.

1. Acceptance of Quotation

Acceptance of any quotation, work order, estimate, invoice, deposit request or commencement of work constitutes acceptance of these Terms and Conditions.

All quotations are based on information supplied by the customer and the intended application discussed at the time of quotation. Any changes to vehicle specifications, equipment, operating conditions, intended use, or scope of work may require a revised quotation and additional charges.

2. Customer-Directed Work

Where a customer requests a specific product, installation method, configuration or outcome that differs from the recommendation provided by All Terrain Action, the customer acknowledges that All Terrain Action cannot guarantee the performance, suitability or reliability of that solution for the customer's intended application.

Any warranty or suitability assurance provided by All Terrain Action applies only to solutions recommended by All Terrain Action based upon the customer's disclosed requirements.

Where work is performed contrary to our recommendation at the customer's request, warranty coverage may be limited to workmanship only and shall not extend to suitability for purpose or system performance.

3. Workmanship Guarantee

All Terrain Action provides a two (2) year workmanship guarantee on all installation and fabrication work performed by our workshop.

This guarantee covers defects arising directly from workmanship, including installation methods, fabrication quality, wiring practices, mounting systems, and assembly performed by All Terrain Action.

Where a workmanship defect is identified within the warranty period, All Terrain Action will rectify the issue at no cost to the customer.

This workmanship guarantee applies only where the installation remains substantially unchanged from its original configuration, no third party has modified, repaired, altered or interfered with the installation, the vehicle or equipment has been used within the intended application discussed and recommended by All Terrain Action, and the claimed fault is not caused by misuse, neglect, accident, environmental damage, overloading, water ingress, impact damage or normal wear and tear.

4. Product Warranty – All Terrain Action Manufactured Products

Products designed and manufactured by All Terrain Action are covered by an eighteen (18) month manufacturer's warranty from the date of installation or purchase.

This warranty covers defects in materials and manufacturing under normal use and operation.

Where a product supplied and manufactured by All Terrain Action is found to be defective during the warranty period, the product will be repaired or replaced at All Terrain Action's discretion. If originally installed by All Terrain Action, labour associated with removal and reinstallation will be provided at no additional cost to the customer. The product must have been used within its intended application and operating limits.

This warranty is provided in addition to any rights and remedies available under the Australian Consumer Law.

5. Third-Party Products and Supplier Warranties

Products supplied by third-party manufacturers remain subject to the warranty terms and conditions provided by the original manufacturer or supplier.

Where a warranty claim arises, All Terrain Action will assist the customer in facilitating the warranty process where reasonably possible.

Warranty approval for third-party products remains at the discretion of the product manufacturer or supplier.

Nothing in these Terms and Conditions limits or excludes any rights available to consumers under the Australian Consumer Law.

6. Labour Associated with Product Warranty Claims

Where a product supplied and installed by All Terrain Action is found to be defective within the applicable manufacturer's warranty period, the defective product will be repaired or replaced and labour associated with removal and reinstallation will be provided at no additional cost where the installation remains substantially unchanged from its original configuration.

Where a product failure occurs after the product warranty period has expired but within the two (2) year workmanship guarantee period, the customer will be responsible for the cost of any replacement product. All Terrain Action will provide labour associated with removal and reinstallation at no additional cost, provided the original installation was completed by All Terrain Action, the installation has not been modified by any third party, and the failure is not caused by misuse, accident, environmental damage, overloading, neglect, or external factors beyond our control.

7. Installation Suitability Assurance

Where All Terrain Action has specified, designed, recommended, or installed a solution based on the customer's stated requirements, intended use, and operating conditions, we warrant that the installation will remain fit for that disclosed purpose throughout the applicable workmanship warranty period.

Should an installation fail to perform its intended function due to workmanship, installation practices, fabrication defects, or implementation errors, All Terrain Action will rectify the issue at no additional cost to the customer.

This assurance applies only to the intended use, operating conditions, and application disclosed by the customer at the time of quotation and installation.

8. Electrical Installation Standards

All electrical work performed by All Terrain Action is completed using accepted automotive industry practices and standards.

This includes, where applicable, appropriate circuit protection and fusing, correct cable sizing and current carrying capacity, suitable connectors, terminals and fastening methods, protection against vibration, abrasion, moisture and environmental exposure, and compliance with relevant automotive electrical standards and industry best practices.

9. Real-World Testing and Intended Use

Where applicable, products designed, manufactured and supplied by All Terrain Action have been developed and tested in real-world Australian operating conditions, including touring, remote travel, four-wheel driving, corrugated roads, off-road environments, vibration-intensive applications, and harsh Australian climate conditions.

This testing is intended to validate product performance and reliability for recreational, touring, off-road and general automotive applications commonly encountered throughout Australia.

Whilst every effort is made to ensure products and installations perform reliably in these conditions, no mechanical, electrical or electronic system can be guaranteed to be free from failure under all circumstances.

Customers acknowledge that product suitability is assessed based on the intended use disclosed at the time of quotation and installation. Any change in application, operating conditions, vehicle configuration or usage requirements may affect product performance and warranty coverage.

10. Commercial, Critical and Mission-Critical Applications

Unless otherwise specified in writing, products and installations supplied by All Terrain Action are designed primarily for recreational, touring, off-road, fleet and general commercial vehicle applications.

Commercial use is generally considered within the scope of intended use and is covered by the warranties contained within these Terms and Conditions.

However, it is the customer's responsibility to advise All Terrain Action before quotation or installation if the intended application involves life support systems, emergency response vehicles, medical equipment, safety-critical systems, communications systems relied upon for emergency operations, remote operations where loss of power or system functionality may create a safety risk, applications requiring continuous operation without interruption, or any application where failure of the system may result in injury, loss of life, significant property damage, business interruption, or substantial financial loss.

Where such requirements exist, All Terrain Action may recommend or require additional engineering controls, redundancy systems, backup power systems, alternative communications methods, monitoring systems, or other risk mitigation measures.

Where a customer elects not to implement recommended redundancy or risk mitigation measures, All Terrain Action accepts no responsibility for losses resulting from a failure of the primary system, except to the extent that such liability cannot be excluded under the Australian Consumer Law.

11. System Redundancy and Reliability

All Terrain Action designs and installs systems in accordance with the requirements disclosed by the customer at the time of consultation and quotation.

Customers acknowledge that all electrical, electronic and mechanical systems are subject to potential failure, whether due to component failure, environmental conditions, accidental damage, manufacturing defects, misuse, maintenance issues or circumstances beyond reasonable control.

Where a customer's application requires a higher level of operational reliability, availability or fault tolerance than would normally be expected in a recreational, touring or commercial environment, the customer must disclose these requirements before installation commences.

Where such requirements are disclosed, All Terrain Action may recommend redundant systems, backup equipment, secondary power sources, alternative communications systems, monitoring solutions or other measures intended to reduce the consequences of equipment failure.

Unless expressly included within the quotation, redundancy systems and backup solutions are not included as part of the supplied installation.

12. Customer Modifications

All Terrain Action warranties apply only to installations that remain substantially in the condition in which they were originally supplied.

Where a product, wiring system, mounting arrangement, software configuration, or installation has been altered, modified, repaired, adjusted, or interfered with by any person other than All Terrain Action, warranty coverage may be reduced or declined to the extent that such modification caused or contributed to the failure being claimed.

13. Customer-Supplied Equipment

Where a customer requests that All Terrain Action install, integrate, configure, modify or connect equipment, products, components or materials not supplied by All Terrain Action, the customer acknowledges that All Terrain Action cannot verify the condition, quality, suitability, authenticity, service history or previous usage of customer-supplied equipment.

All Terrain Action provides no warranty in relation to the performance, reliability, compatibility, quality or fitness for purpose of customer-supplied equipment. Any manufacturer's warranty, supplier warranty or consumer guarantee relating to customer-supplied equipment remains the responsibility of the original supplier or manufacturer.

Where customer-supplied equipment is installed by All Terrain Action, our workmanship warranty applies only to the installation work performed by All Terrain Action and does not extend to the supplied product itself.

Should a fault occur that is determined to be caused wholly or partly by customer-supplied equipment, associated diagnosis, removal, testing, reinstallation, rectification and replacement labour may be chargeable.

All Terrain Action reserves the right to refuse installation of customer-supplied equipment where, in our opinion, the equipment is unsuitable, unsafe, incompatible, non-compliant, counterfeit, damaged, modified, poorly manufactured or otherwise presents a risk to vehicle safety, reliability or system performance.

14. Exclusions

The warranties contained within these Terms and Conditions do not cover normal wear and tear, consumable items, cosmetic deterioration, damage caused by accidents, misuse, abuse, neglect, improper operation or unauthorised repairs, damage caused by water ingress, corrosion, impact, fire, theft, vandalism or environmental exposure, overloading or operating equipment outside its intended design limits, damage resulting from third-party equipment, accessories or installations, vehicle manufacturer defects unrelated to products supplied or work performed by All Terrain Action, or loss of income, loss of use, accommodation costs, travel costs, freight costs or consequential losses except where required by Australian Consumer Law.

15. Warranty Claims

Customers must notify All Terrain Action as soon as reasonably practicable after becoming aware of a fault.

Proof of purchase may be required before a warranty claim can be assessed.

All warranty inspections, assessments, repairs and replacements must be carried out by All Terrain Action or an authorised representative unless prior written approval has been obtained.

Failure to provide a reasonable opportunity to inspect and assess the claimed fault may result in warranty coverage being declined.

16. Vehicle Collection, Storage and Abandoned Vehicles

Customers must collect their vehicle, trailer, caravan, boat or equipment within seven (7) days of being notified that work has been completed, unless alternative arrangements have been agreed in writing.

All Terrain Action reserves the right to charge storage fees for vehicles, trailers, caravans, boats or equipment not collected within the collection period. Applicable storage fees will be advised at the time of invoicing or notification.

Where an invoice remains unpaid or a vehicle remains uncollected, All Terrain Action reserves all rights available under applicable legislation, including the right to retain possession of the vehicle or equipment until payment is made in full.

Any costs incurred by All Terrain Action in storing, securing, recovering or managing uncollected property may be recovered from the customer.

Where a vehicle or item remains uncollected for an extended period and reasonable attempts to contact the owner have been unsuccessful, All Terrain Action may exercise any rights available under applicable Victorian legislation relating to abandoned goods.

17. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with goods, customers are entitled to choose a replacement or refund and compensation for any other reasonably foreseeable loss or damage.

Customers are also entitled to have goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.

For services, customers are entitled to remedies where services are not provided with due care and skill, are not fit for their disclosed purpose, or are not supplied within a reasonable time where no timeframe has been agreed.

The benefits provided by All Terrain Action's workmanship guarantee and manufacturer's warranty are in addition to other rights and remedies available under the Competition and Consumer Act 2010 (Cth), Schedule 2 – Australian Consumer Law.

18. Limitation of Liability

To the maximum extent permitted by law, All Terrain Action's liability is limited to the repair, replacement or rectification of defective goods or services supplied by All Terrain Action.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law which cannot be lawfully excluded.
